The agreement between you, AIWine and the wineries you buy from — and the rights New Zealand law gives you either way.
aiwine.co.nz is operated by AIWine Ventures Limited (Company No. 9435521). Each wine is sold by the winery that supplies it — AIWine acts as the winery's agent: we take your order, collect payment on the winery's behalf, and the winery packs and dispatches the wine direct to you. Your contract for the wine itself is with that winery.
AIWine holds its own off-licence under the Sale and Supply of Alcohol Act 2012, held in addition to each winery's own licence and covering sales transacted through this site (see the footer for licence holder, number and expiry, with a link to a copy of the licence). That licence governs how the sale is transacted and delivered — it does not change who owns or sells the wine: that remains the winery, which accounts for GST on the sale. AIWine's commission for facilitating the sale is invoiced separately to the winery. AIWine's GST number (GST No. 148-900-086) appears on your receipt when AIWine collected the payment as the winery's agent; it does not mean AIWine accounts for GST on the wine. The winery accounts for GST on the wine sale, and AIWine accounts for GST on its commission only.
By using the site or placing an order you agree to these Terms, our Privacy Policy and our Delivery, Discounts & GST terms, which form part of this agreement.
When a winery takes your payment directly. Some wineries take payment through their own Stripe account. Checkout tells you before you pay, and a case holding their wine and other wineries' wine is paid in separate parts. For those wines the winery itself takes your payment and sells the wine to you under its own off-licence, whose holder, number and expiry are printed on your receipt; AIWine provides the marketplace and is paid a commission by the winery. Everything else in these Terms — age, delivery, returns — applies the same way.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Wine sold to you must be of acceptable quality and match its description.
To the extent permitted by law, and without limiting your Consumer Guarantees Act rights, AIWine's liability for the platform is limited, and the supplying winery is responsible for the wine it sells and dispatches. We are not liable for delays outside our or the winery's reasonable control.
